Stunning Incompetence: February 2025 California Bar Exam Sparks Lawsuit
Widespread Technical Failures Lead to Immediate Legal Action
Only one day after thousands of applicants encountered catastrophic technical failures during the February 2025 California Bar Exam, a lawsuit has already been filed in federal court. The plaintiffs, comprised of test-takers, allege that their years of preparation, substantial financial investment, and career aspirations were jeopardized by the negligence of Meazure Learning (formerly ProctorU Inc.), the company responsible for administering the exam.
A Flawed Exam System: What Went Wrong?
Historically, the California Bar Exam has been conducted in large convention centers across the state. However, in February 2025, the State Bar of California introduced a new digital format in collaboration with Kaplan Exam Services, LLC and Meazure Learning. Plaintiffs claim that Meazure's rushed deployment of untested software failed to accommodate the 5,600 applicants who relied on computers to take the notoriously difficult exam.
As a result, test-takers faced:
- Continuous platform crashes
- Software malfunctions
- Persistent error messages
- Inability to access test questions
- Lost or unsaved answers
- In some cases, an inability to complete the exam
California Senate Inquiry and Law School Deans Demand Action
Beyond the legal action, the Chair of the Senate Judiciary Committee, Sen. Tom Umberg (D-Santa Ana), has called for a formal audit into the catastrophic exam failure. He vowed to seek an investigation to determine “what went so spectacularly wrong” with the February Bar Exam’s administration.
Additionally, Berkeley Law Dean Erwin Chemerinsky and other law school deans sent a letter to California Chief Justice Patricia Guerrero, urging intervention. Chemerinsky condemned the mishandling of the exam as “stunning incompetence from an entity that exists to measure competence.”
The Lawsuit: Key Claims and Potential Implications
The lawsuit filed in federal court includes three individual plaintiffs seeking monetary damages and injunctive relief. The legal claims include:
- Breach of Warranty
- Violations of Consumer Protection Laws
- Unfair Competition Law Violations
- Unjust Enrichment
- Negligent Infliction of Emotional Distress
The plaintiffs argue that their collective claims exceed $5 million (excluding interest and costs). Whether the case will proceed as a class action lawsuit remains to be seen, but with 5,600 affected test-takers, more legal challenges could be on the horizon.
